- DirectorLew LandersStarsHenry HunterAnn ShepherdAlan DinehartIn a state penitentiary on New Year's Eve, gangster "Okay" Percy Smith knifes fellow inmate Zingo Browning, killing him. The next day, convicted lawyers Russell Whalen and Marty Crawford plead their cases before the Parole Board. Russ is released on parole, while Marty is ordered to remain behind bars until Zingo's murder is solved. Marty is in prison for fixing a jury to save an innocent man, and when Russ is released, he arranges for Russ to work with his old law partner, Jack Driscoll. The twenty-four-year-old Russ was convicted of killing a man in a car accident and is eager to make good, but Driscoll assigns him to Richard K. Mallard, a crooked politician who believes in astrology and is the boss of the city graft machine. Okay, who was let out of prison when Mallard paid a woman to pose as Okay's fainting mother, takes Russ with him when he collects money from the businessmen whom Mallard controls. When Russ sees Okay nearly kill a man for refusing to give up his city contract to Mallard, he saves the man, then quits Mallard's service. Marty's daughter Frances then gets Russ a job with her boss, manufacturer Rex Gavin, who is spearheading an anti-parole campaign in an effort to fight the recent crime wave perpetrated by released convicts. Okay then robs a bank in order to pay Mallard's aide, John Borchard, for securing the release of Russ's friend, Bobby Freeman, from prison so Okay will have a scapegoat when he needs one. After Bobby goes to live with Russ, Marty is released from prison, and when Driscoll visits, Russ rails at him for associating with Mallard. Borchard then tells Gavin he has an ex-convict working for him, and Gavin fires not only Russ and Frances, but five other good workers who also happen to be ex-convicts. When Post Courier reporter Gregory interviews Russ about the Gavin Manufacturing Company dismissals, he reveals all he knows about Mallard's operation to paper chief Earl Bigbee. After headlines implicate Mallard, Driscoll offers Russ his apartment as a hiding place. Okay and Dummy Watts, who had also been in the state prison, then force Bobby to lead them to Russ. At Driscoll's apartment, Bobby and Russ struggle to keep out Okay and Dummy, but the thugs get the door open and shoot and kill Bobby. Marty is wounded trying to escape, and Russ is blamed for the shooting and is jailed after revealing Okay and Dummy's hideout to be a barge. At the barge, the police cuff Dummy and Okay, but Okay jumps into the water and is shot at as he swims away. Joyce Daniels, Mallard's secretary who is in love with Russ, then gives Frances the records needed to incriminate Mallard and free Russ. After she is abducted by Borchard and killed, Frances hands over the evidence to Gavin, who organizes the city leaders and the governor to investigate and try Mallard. Mallard is exposed as a grafter, and Russ is exonerated and meets with the authorities to discuss a revitalization of the state parole system. Mallard is indicted, but flees bench warrant by hiding out in the mortuary of A. R. Patton, where Bobby's body is interred. With Borchard, Mallard tries to escape to Rio de Janiero in Bobby's coffin, but Russ arrives with police inspector Hamilton, who shoots Borchard and arrests Mallard. Governor Slade then appoints the chair to a new parole board, which includes a psychiatrist, and Gavin agrees to help prepare criminals for jobs after parole. Slade pardons Marty and Russ, who can now marry Frances, and Mallard gets fifty years in prison. Russ and Marty look forward to a future as "Whalen and Crawford, Attorneys at Law."

Next, Odette La Vin checks into Twitchell Arms with ex-con Nick Mazaney in order to blackmail Wagon with a bigamy scandal by claiming she is his daughter. However, Callaghan, who hired Mazaney to get rid of Wagon, realizes Mazaney might get a higher price from Wagon by letting him win the election and has him arrested. Odette goes ahead with her scheme, however, and gives Wagon one day to come up with $10,000. Hank then gets Sim drunk to land him in jail with Mazaney and interview him. Odette makes her move during a campaign speech, calling Wagon "father" and getting her story in the newspapers. Callaghan is confused because he knows Odette is not on the payroll. Hank then makes a speech to Wagon's constituents about the cause being "greater than any individual," making a case for Sim to run for mayor on the laurels of his editorials, which have been criticizing Callaghan and his grafters. In jail, meanwhile, Sim offers his cold medicine to Mazaney, who apparently falls dead. Sim is accused of murder until Hank discovers a poisoned cigarette butt in the cell, which was delivered by a messenger to Mazaney. The messenger identifies Wagon as the murderer, but Hank proves the cigarettes came from Odette. Mazaney then recovers and the police arrest Odette for a string of crimes perpetrated across the country. Sim runs for mayor against Callaghan and wins, but, much to Sim's relief, Callaghan reveals that Sim is a Canadian citizen and kicks Hank out of town.

Warren releases Touhy's cohorts--Herman "Owl" Banghart, Bernard "Troubles" O'Connor, Icebox Hamilton, Maxie Sharkey and Thomas J. "Smoke" Reardon--from custody but vows to pursue them. In Dec 1933, after Prohibition is repealed, Touhy decides to go "straight" because he is tired of pressure from Warren and the police. Needing money to buy a brewery, Touhy asks businessman Joseph P. Sutton to repay the $200,000 that he owes him. Although Sutton has the money, he claims that he does not, and his partner, Edward Latham, advises him to stall Touhy. Fed up with waiting, Touhy and his men kidnap Sutton and eventually collect $70,000 ransom from Latham. After Sutton is released, Warren pressures him to identify Touhy's gang as the kidnappers, and the reluctant businessman finally does so, although he does not reveal his prior connections to Touhy. While Touhy and his men are leaving the area, they are involved in a minor automobile accident that leads to their arrest. During their trial, Smoke testifies against Touhy and the others, who are found guilty and sent to serve ninety-nine-year sentences in the Stateville Peniteniary at Joliet, Illinois. Touhy is infuriated by Smoke's betrayal, and as the next eight years pass, continually tries to obtain a new trial. Smoke, who has been in hiding, is caught by some of Touhy's followers on the outside and framed for a crime he did not commit. Smoke is then sent to the penitentiary, and after being terrorized by Touhy, agrees to recant his testimony and help to free the gang. Smoke is killed by another prisoner before he can talk, however, and a desperate Touhy plans to escape from the prison. With the help of a prison guard, Touhy and his cellmate, George Carroll, escape along with Owl, Troubles, Icebox, Maxie and Rowden, another prisoner. Because the United States is now involved in the war, Touhy knows that the men will be arrested if they are caught without draft cards, and so orders Carroll and Rowden to rob unsuspecting citizens of their cards. The Federal Bureau of Investigation then takes over the case, as Touhy and his men have violated the Selective Service Act, first by not notifying the draft board of their "change of address," and then through their theft of the draft cards. Maxie's drunken carelessness causes Touhy to beat him viciously, and after Maxie and Icebox leave the gang, Icebox is arrested and informs the police of Touhy's whereabouts. Soon after, Rowden and Carroll are killed when F.B.I. agents attempt to apprehend them. Working with Warren, the F.B.I. then surrounds the apartment where Touhy, Troubles and Owl are living, and Owl convinces Touhy to surrender quietly, telling him that it is now time to pay for being on top for so long. Touhy and his men are then returned to Joliet.
