A legal showdown between Ultimate Fighting Championship and more than 1,200 fighters suing for wage suppression is headed to trial.
A federal judge, in an order issued on Thursday, turned down a bid to dismiss the lawsuit accusing UFC of engaging in an illegal scheme to build and maintain a monopoly by systematically eliminating competition from rival mixed martial arts promoters. U.S. District Judge Richard Boulware pointed to evidence that the company may have “foreclosed a large share of fighters,” especially those who are top-ranked, from the market.
At the center of the case: Allegations that UFC used longterm, exclusive contracts to substantially delay, or in some cases, totally prevent free-agency; coerced fighters into re-signing deals; and acquired or closed down multiple competing Mma promoters in violation of antitrust laws.
As a result of the alleged scheme, the class action argued UFC wields “monopsony power” — a dynamic in which a single buyer owns a monopoly,...

Meta Won Approval to Buy a Virtual Reality App, But FTC Laid Groundwork to Halt Big Tech’s Next Deal
The Federal Trade Commission’s lawsuit to block Facebook parent company Meta’s acquisition of virtual reality app developer Within presented the court with a legal question that used to exist on the periphery of antitrust law and is now critical to the government’s efforts to rein in big tech: How to assess proposed deals by dominant firms in nascent markets.
During the seven-day trial in December where the FTC challenged the deal because it allegedly put Meta in prime position to monopolize VR fitness apps, the company questioned how the acquisition of one app in a developing market could harm competition. U.S. District Judge Edward Davila approved the deal in a blow to the agency’s bid to dismantle the tech giant but advanced one of its key legal theories arguing that the purchase of competitors in budding markets can hurt competition. Additionally, he agreed with the...

Washington — The Justice Department’s approval of The Walt Disney Co.’s purchase of Fox assets is quicker than Wall Street analysts and others were expecting — and it certainly has implications as Comcast weighs whether to counter its counter offer.
Ubs’s Media and Pay TV analysts called it a “FastPass approval,” while MoffettNathanson wrote that “it seems to us that the pressure is now back on Comcast to come in with a more significant bid above Disney’s $38 per share offer to help sway the 21st Century Fox Board to reject the bird in the hand regulatory clearance.”
Comcast’s proposed merger with NBCUniversal was unveiled in late 2009, but took more than a year to secure a green light from the Doj and the FCC. At&T’s acquisition of Time Warner, first proposed in October 2016, took more than 18 months as the government challenged it in court.

Updated Washington — After its definitive defeat in the At&T-Time Warner trial, the Justice Department’s Antitrust Division is now weighing whether to appeal.
On Wednesday, a number of public interest groups, Wall Street analysts, and lobbyists were also asking another question: Will this make the Doj more reluctant to challenge other vertical transactions?
As he left the federal courthouse in Washington on Tuesday, Makan Delrahim, the Justice Department’s antitrust chief, said that they would review the opinion of U.S. District Judge Richard Leon “to see what impact it will have on other mergers.”
The Doj is mulling whether to appeal. The government could also seek a stay to halt the transaction from moving forward as it weighs that decision, but the Justice Department would have to decide by Monday. Leon made clear that he would reject a stay, but the Doj could also seek such a...
